Expungements:

If I was convicted of a crime am I eligible for an expungement?
No, you must apply for a pardon if you were convicted.

Am I eligible if i had ARD (Accelerated Rehabilitative Disposition)?
Yes, if you completed all of the assignments, paid all restitution if any, and paid all costs and fines, you are eligible for an expungement. However, certain crimes are not eligible for expungement even if you were given ARD, such as rape and other related cases of a sexual nature.

What if I was convicted on another matter, can I get this one expunged?
Yes, if you were not convicted of any crime related to the arrest for which you are seeking the expungement, you can get that case expunged.

Do I have a right to an expungement?
Yes.

I read that if you are over 70 you can have a conviction expunged, is this a myth?
This is not a myth, this is true. After a conviction, the only two ways to obtain an expungement are if you have reached 70 years of age or have been deceased for three years. 

I know I was never convicted, but I am not sure of the disposition of the case, how do i know if i am eligible for an expungement?

Pardons:

Does everyone get a hearing?
Not at all, in fact most people do not get a hearing. The Board of Pardons only grants a hearing for those people they truly believe might meet all of the categories listed in the application.

I have friend or family member who is currently incarcerated who is terminally ill, can a pardon be granted so that person can receive treatment?
Yes. One of the factors the Board of Pardons review in the application is the reason the applicant is seeking the pardon. While the Board does not release to the public specifics on exactly what they find to be a compelling reason for a pardon, terminal illness is a valid reason to make the application.

Can a pardon be granted to commute someone from death row to life?
Yes. A pardon can be granted to commute a death sentence to a life sentence.

If I apply for a pardon will my name appear in my local paper and state the crime for which I was convicted?
Yes. If a hearing is granted, your picture will be published in a local paper so that members of the community can protest your application.

How much do you charge for a Pardon?
Pardons are quite different from expungements because they are much more in depth. Generally we recommend a free consultation to all of our prospective pardon clients. However, in general the fee is broken into two stages: first, the application preparation review fee; and second, a fee for the hearing if the hearing is granted.
